CODE OF CONDUCT
Purpose of the Code of Conduct is to ensure all Members, Guests, Visitors, Contractors and Staff have a clear understanding in regard to the standards of behaviour deemed acceptable to the Management so as to ensure a safe, welcoming and respectful environment at all times. Anyone who is on the property (23 Gwydir Street Moree NSW 2400) is bound to observe the Membership Form Agreement and Terms & Conditions, and agrees to abide by the following Code of Conduct guidelines:
• Treat one another with dignity and respect
• Contribute positively to a safe and harmonious environment
• Foster a friendly, constructive and inclusive environment
• Not participate in any discrimination, vilification, humiliation, verbal or sexual harassment, violent or abusive behaviour towards any other person
• Not use foul, abusive, argumentative or excessively loud language which may impact on other patrons or staff
• Avoid alcoholic or other illicit drug intoxication whilst on the property
• Treat equipment and property with respect
• Observe Dress Regulations
Patrons authorised to be on the property must be a Member, or the Guest of a Member (duly signed in), or a Visitor to the site, or a Visitor (signed in as a Temporary Member), or a Contractor or their staff, or a member of Staff. If a person on or in the property is not any of these or is a Member or Reciprocal Member who has not produced their membership id or proof of sign in when requested to by a staff member, Management may order them to leave or have them removed from the property, without further explanation.
Management has the authority: to cancel or refuse Members or Guest of Members without explanation. All members, staff, guests and contractors are expected to read, understand and abide by the Code of Conduct.
MEMBERSHIP AGREEMENT & TERMS AND CONDITIONS
1.0 Guest or Member: Use of the pool hall is only permitted by authorised guests or members.
1.1 Pricing: Prices may change without notice.
1.2 Reservations: Pool Table reservations are not available so access to play on a pool table is on a first-come, first-served bases. There is no limit to how long a “Guest” or “Member” may use a pool table however, “Guests” and “Members” are encouraged to share a table when all tables are occupied and others are waiting to play. Management of the “Club” reserves the right to reserve any and all pool tables at any time at is sole discretion. A reservation placard will be placed on the table when the table is reserved. Notice for reservations will be placed at the primary site entry point and may be listed on social media profiles. All competition nights will deem all pool tables reserved without formal notice. Any patrons using the facility prior to either a competition or function will be asked to vacate the premises.
1.3 Opening Hours Opening hours can vary without notice / Function: As per booking. Social: Thursday 7pm-10pm. Competition: As per competition. Key Membership 7 days, 10am – 10pm.
1.4 People Per Table Minimum 1 person per table and maximum 4 persons per table
1.5 Spectators Not allowed unless authorised. An entry fee may be required as per management discretion.
1.7 Membership Guests To pay an hourly fee as disclosed by management.
1.7 Payment All payments to be made in cash only.
1.8 Damage All damage to property or equipment will be reported to police. Destruction, or vandalism of any kind, of the facilities, personal property, equipment, fixtures, pool tables or other property shall result in a fine of actual cost of damages including loss of income and legal fees.
1.9 Theft Any theft of equipment will be reported to police. Theft of any kind, of the facilities, personal property, equipment, fixtures, pool tables or other property shall result in a fine of actual cost of stolen items including loss of income and legal fees. Spectators, Guests and Members understand and agree that the “Club” shall not be liable for the loss, theft, or damage to personal property of Spectators, Guests and Members.
1.10 Surveillance The property and facilities are monitored using surveillance cameras 24 hours a day, 7 days a week. “Spectators,” “Guests,” and “Members” understand if on the property (23 Gwydir Street Moree) video security cameras and surveillance will be utilised to ensure the safety of all Spectators, Guests, Members and contractors. Spectators, Guests, Members and contractors consent to video recordings while on premise.
1.11 Social Media Spectators, Guests, Members and contractors consent to video recordings and photographs to be used for social media purposes. First names may be included in public posts.
1.12 Security Doors and gates must remain closed and locked at all times before and after leaving the property and building. Doors may not be propped open and left unlocked. All windows must remain closed at all times unless otherwise opened by management.
1.13 Parking Street parking is available on Gwydir Street.
1.14 Closures Spectators, Guests and Members understand and agree that the “hall” is not in breach of this agreement or liable for maintenance or mandatory closures.
1.15 Drugs: Spectators, Guests or Members may not bring drugs, alcoholic beverages or like-substances into the property (23 Gwydir Street Moree) or building. Designated areas may be used for smoking.
1.16 Under Influence Spectators, Guests or Members agree not use the facility or engage in any activity on the property or Club while under the influence of drugs, alcohol, or medication that may impair their ability to operate equipment safely.
1.17 Food: Pool tables are for regulation pool practice and games only. No food or drinks are allowed on pool tables.
1.18 Lights Ensure to turn all lights off when leaving the building.
1.19 Cleaning Patrons are required to clean up after yourself. This includes throwing trash in garbage and sweeping floor if you spill food or track dirt in. Clean bottom of shoes before entering hall.
1.20 Rules Spectators, Guests or Members agree to abide by all rules on display on the premises.
1.21 Termination Management reserves the right to terminate access for Spectators, Guests or Member at any time for any reason it deems necessary without notice. This includes violation of any of the terms and conditions of agreement
1.22 Emergency In the event of an emergency Spectators, Guests or Members must contact emergency services on “000” immediately.
1.23 Amendments This Agreement may be amended from time to time. The most recent version will be accessible on site at 23 Gwydir Street Moree NSW 2400.
2.0 Fit for Purpose
2.1 You must not enter the premises at 23 Gwydir Street Moree NSW 2400:
(1) unless you reasonably believe based on reasonable grounds known to you that you are fit and able to undertake cue sport activities.
(2) that is contrary to advice given to you from a doctor, Allied Health, any medical professional or from advisory papers supplied with any medicines you are taking; or
(3) whilst you are carrying an injury or have reasonable grounds to suspect you are carrying an injury.
2.2 If you are suffering from any injury or illness and wish to undertake cue sport activities within the property you must notify management before commencing any exercise of that illness or injury and sign a disclaimer in favour of us in respect of any damage of injury you might suffer from exacerbating, complicating or suffering consequential injury flowing from that activity or flowing from that illness or injury.
2.3 You agree to use our facility, products and services with due care and reasonable skill and on the condition that if you have any difficulty using any equipment, that you will cease using that equipment unless and until you have notified Management and been given guidance on the use of that equipment and you have been given approval by Staff to continue using that equipment.
2.4 Should you injure yourself, or get hurt while utilising our Facilities, products and/or services, you will immediately cease activity and notify Management. It is a condition of entry into and use of the property that you must take full responsibility for your actions and you indemnify us against any costs, losses or damages we may suffer in relation to your actions or injury whilst attending the property.
3.0 Risk
3.1 You understand and acknowledge that:
(1) during such times that you frequent the property (23 Gwydir Street Moree) or participate in an activity, be it internal or external, that you are doing so at your own risk;
(2) the risk of injury from using equipment in the property (23 Gwydir Street Moree) or participating in activities is significant, and may include permanent paralysis or death and you knowingly and freely assume all such risks;
(3) we purchase or lease all equipment from third parties and therefore do not manufacture any of this equipment, and we are providing recreation services and may not be held liable for defective products or equipment;
(4) you will not hold us or our Related Entities liable for any personal injury, damage to or loss of belongings which may arise from ours, or our Staff, members, clients, contractors or associates, negligence;
(5) whilst on the property (23 Gwydir Street Moree) you may at times be unsupervised and you assume all risks associated with using equipment alone without the aid and presence of any Staff;
(6) subject to this Agreement, you are not otherwise entitled to bring any guests on to the property (23 Gwydir Street Moree) without our prior written consent, and if you do so, we may, at our sole discretion, suspend or cancel your Membership and the remainder owing on the Membership will be a debt due and payable to us;
(7) we have the right to cancel or suspend your Membership and exclude you from the property (23 Gwydir Street Moree) (in each case, temporarily or permanently at our sole and absolute discretion) if you do not behave in an orderly manner, are under the influence of alcohol or drugs, are abusive to Staff and/or other members, use equipment improperly, dangerously or in a way that may lead to personal injury (whether to you or others) or you cause property damage of any kind, or do not adhere to any of the terms of this Agreement; and
(8) by becoming a Member, you understand that this Agreement is legally binding whether your use is limited to a full (key) or guest (function, social, spectator) member.
4.0 Release and Indemnity
4.1 You hereby release and indemnify us and our Related Entities, our respective officers, affiliates, agents, Staff, employees, contractors, and other participants, with respect to any and all injury, disability, death or loss or damage to person or property, whether arising from our negligence or otherwise, that may arise out of or in connection with your use any of the equipment or the facilities provided by us, your participation in any activity, or any incident that occurs while using the facilities, participating in any activity or on the property (23 Gwydir Street Moree).
4.2 To the extent permitted by law, we and our Related Entities hereby exclude any liability to you for any injury, loss or damage to you or your property sustained by you or any other person for any costs, charges and expenses incurred by you arising from or in connection with this Agreement and/or the services provided by us and including any act or omission by us.
4.3 You expressly agree that this release is intended to be as broad and inclusive as permitted by law. If any part of this Agreement is void, unenforceable or illegal in a jurisdiction it is severed for that jurisdiction. You acknowledge that the remainder of this Agreement has full force and effect and the validity or enforceability of that provision in any other jurisdiction is not affected.
5.0 Privacy Statement & Policy
5.1 You agree that the information which we collect and retain about you can be used in accordance with our Privacy Policy and that those terms are incorporated herein by reference.
5.2 Our Privacy Policy is located on site at 23 Gwydir Street Moree NSW 2400.
5.3 You further acknowledge that the property utilises CCTV for security and monitoring purposes.
5.4 Personal information we collect and hold: The personal information collected and maintained includes:
• your name, date of birth, gender, address, email address, contact details, and information specific to your dealing or enquiry with us. This may include photo identification.
• Employment details
• Emergency contact information
5.5 We collect and handle your personal information when fulfilling one of our functions or delivering a service. We collect your personal information to:
• assist you with determining your application for membership purposes, and
• to be used in accordance with the terms that are incorporated herein by reference
5.6 We collect personal information directly from you.
5.7 We may ask you to provide us with information over the telephone, through our website, by completing a form or survey, or meeting with us face-to-face.
5.8 You might also provide your personal information to us without us directly asking for it - for example, by engaging with us on social media.
